The Educational Requirements
for an H-1B Visa
The foreign national must possess at least a bachelor's degree or its equivalent. Furthermore, if a license is required under state law to practice a specific specialty occupation, the foreign national must hold the appropriate state license in the state of intended employment.
If a foreign national does not meet the educational requirements, than work experience may be substituted. Three years of professional experience is considered equivalent to one year of college education.
If the foreign national was awarded his/her degree from an institution not located in the U.S., that degree must be evaluated to determine if it is comparable to a U.S. awarded degree from an accredited institution. If the foreign national possesses a bachelor's degree or its equivalent, work experience is not required.
The foreign national can also qualify through a combination of education and professional work experience in a related area as long as it equates to a U.S. Bachelor's degree.
