Effects of Mergers and Acquisitions on the PERM Process
A PERM Labor Certification may continue and is valid as long as the new company is the successor in interest to the original company that filed the PERM. If the new company took all the benefits and liabilities of the former company, the new company will be deemed to be the successor in interest and the new company may continue the Labor Certification process for the foreign national.
The same concept of "successor in interest" applies to other pending petitions filed by a sponsoring company.
