Specialty Occupation Defined
The term "specialty occupation" is defined as an occupation that requires:
- A theoretical and practical application of a body of specialized knowledge
- The attainment of a Bachelor's Degree or higher (or its equivalent) in the specific field as a minimum entry requirement into that occupation in the United States.

In order to establish that a position is
a specialty occupation, one of the following must be established:
- A bachelor degree or higher (or its equivalent) is normally the minimum entry requirement for the position.
- The degree requirement for the position is common in the industry or the position is so unique or complex that it can only be performed by someone with such a degree.
- The employer normally requires a degree or its equivalent for the position.
- The nature of the job duties is so specialized and complex that the knowledge required to perform the duties is usually associated with a bachelors degree or higher .
